The program will discuss recent liability cases for corporate trustees,
including joint and several liability for custodial trustees for
failing to prevent embezzlements. Similarly, the scope of the duty to
diversify has been fleshed out with decisions on liability for failure
to act with prudence despite retention language and failure to
diversify promptly. These situations could likely have been prevented
by careful supervision and appreciation of the requirements of the
Prudent Investor Act. A variety of other liability issues will also be
discussed.
